1) Accounts & eligibility
- You must be at least 13 years old (or the age required by your jurisdiction) and able to form a contract.
- Keep your credentials confidential; you’re responsible for activity under your account.
- Provide accurate information and update it when it changes.
2) No medical advice
Popweave is not a medical provider. Content is for information and engagement only. Always seek the advice of a qualified professional.
3) Acceptable use
- No unlawful, infringing, or harmful content or behavior.
- No attempts to bypass security, reverse engineer, or disrupt the service.
- No scraping or automated extraction without prior written consent.
4) Privacy & data handling
Our Privacy Policy explains how we collect, use, and protect data, including PHI when HIPAA applies. When we act as a Business Associate, our BAA governs PHI processing with the covered entity.
5) Security, incidents, and your responsibilities
- We use reasonable and appropriate safeguards (encryption, access controls, monitoring) to protect the service.
- You must use unique, strong passwords; enable MFA where offered; and promptly notify security@popweave.com of any suspected compromise.
- If a security incident affects your data, we will notify you as the law requires and work to mitigate the impact.
- Responsible disclosure: report vulnerabilities to security@popweave.com. Don’t test in ways that could harm users or data.
6) Third-party services
Some features depend on third-party services (e.g., hosting, communications). We’re not responsible for their availability, but we vet service providers handling personal data.
7) Intellectual property
Popweave owns the service and its content (excluding your data). You may not use our trademarks or code without permission.
8) Warranty disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT). We do not warrant uninterrupted, secure, or error-free operation.
9) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPWEAVE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.
10) Indemnification
You will defend and indemnify Popweave against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the service, violation of these Terms, or violation of law.
11) Suspension & termination
We may suspend or terminate access for violations or to protect the service. You may stop using the service at any time.
12) Changes to the service or terms
We may update the service and these Terms. If changes are material, we’ll provide notice (e.g., email or in-app). Continued use means you accept the changes.
13) Governing law & disputes
These Terms are governed by the laws of the State of Minnesota and the United States, without regard to conflicts of law. Venue lies in state or federal courts located in Minnesota. You and Popweave waive jury trial to the extent permitted by law.
